Court Rejects Appeal of Murderer, Sentenced to 14 Years

On February 8, 2012 the RA Criminal Court of Appeals dismissed the appeal made by Vram Baghdasaryan's lawyer and left standing the decision of the Court of First Instance of Arabkir and Kanaker-Zeytun administrative districts issued on November 16, 2011.

The Court justified the accusation against 5 persons for committing hooliganism and against V. Baghdasaryan for committing hooliganism, murder and illegal keeping of weapons and sentenced them to imprisonment.

In particular, according to the Court decision, on May 12, 2010 V. Baghdasaryan had a quarrel with Kh. Mkrtchyan's friend D. Sandaljyan. The latter threatened V. Baghdasaryan and said openly said “You are dead”. Then, D. Sandaljyan asked his brother H. Sandaljyan and Kh. Mkrtchyan to settle a score with V. Baghdasaryan.

With the purpose to continue the quarrel on the same day at 22:30 V. Baghdasaryan together with his friends P. Grigoryan, A. Aharonyan and H. Hakobyan met Kh. Mkrtchyan and his friends H. Sandaljyan and A. Pokharyan near the buildings 17 and 19 of Komitas Avenue. They quarreled and beat each other.

During the quarrel V. Baghdasaryan used illegally obtained and kept factory made “PM” type of gun and fired in Kh. Mkrtchyan's direction. As a result of this Kh. Mkrtchyan was hit and died.

By the decision of the Court of First Instance of Arabkir and Kanaker-Zeytun administrative districts issued on November 16, 2011 V. Baghdasaryan was found guilty according to the RA Criminal Code Articles 104, part 2, points 6 and 10, 235, part 1 and 258, part 4 and was sentenced to 14 years of imprisonment.

A. Aharonyan, H. Sandaljyan and A. Pokharyan were found guilty according to the RA Criminal Code Article 258, part 4 and were sentenced to 5 years of imprisonment.

P. Grigoryan was found guilty according to the RA Criminal Code Article 258, part 3 and was sentenced to 3 years of imprisonment.

D. Sandaljyan was found guilty according to the RA Criminal Code Article 137, part 1 and was sentenced to 2 years of imprisonment.

Prosecotor General's Office reports that P. Grigoryan and D. Sandaljyan were released from punishment based on National Assembly's decision “On announcing amnesty on the occasion of the 20th anniversary of the declaration of the RA independence” issued on May 26, 2011.
